Africanisp: General Terms and Conditions of Service

These are the terms and conditions agreed between Africanisp and the “Customer”

1. Supply of Service

1.1 Africanisp shall supply the various web hosting plans that are outlined on its website at http://www.africanisp.co.za

and shall deliver the ordered option once full payment has been made.

1.2 Africanisp shall inform you of any delay in the delivery of the service as soon as is reasonably practicable.

1.3 Africanisp will at its sole discretion provide you with access to other resources to

facilitate your use of its service.

2. Description of the Service

2.1 A description of the service can be found on Africanisp web site at http://www.africanisp.co.za

2.2 As a condition of your use of the Africanisp services you warrant that you will not use the Network Service for any unlawful purpose.

Transmission, distribution, or storage of any information, data or material in violation of South African regulations or law, or by common law, is prohibited.

This includes, but is not limited to, material protected by copyright, trademark, trade secret, pornography or any other statute.

We reserve the right to remove such illegal material from the Africanisp servers immediately.

2.3 Web Site Content Full back-ups are made daily, weekly and monthly on the network itself. No guarantees are made of any kind,

either expressed or implied, as to the integrity of these back-ups. Back-ups are made for server restoration purposes only.

You are responsible for keeping a copy of your most current web site files as backup on a remote system. We are not responsible for any lost

files, information, or data. However, if any loss of data occurs due to an error at the Africanisp servers, we will use all reasonable efforts

to recover the data at no charge to you. If data loss occurs due to your negligence in securing your account or due to an action on your part,

we will use all reasonable efforts to recover the data from the most recent archive for a hundred and fifty (R150.00) Rand per hour fee.

2.4 Zero Tolerance Spam Policy
We takes a zero tolerance stance against sending of unsolicited e-mail, commonly known as spam.

Any user who sends out spam will have their account terminated without notice, and may be charged a one time administration fine of one

hundred (R100) Rand if we can show proof that the user sent the e-mail from our servers or network.

We reserves the right to require changes or disable as necessary

any web site, account, database, or other component that does not comply with this policy, at its sole discretion.

We also reserve the right to make any such modifications in an emergency at our sole discretion

3. Your Obligations

3.1 In order to utilize Africanisp hosting services, you must obtain access to the Internet and pay any fees associated with this access.

In addition, you must provide all the equipment necessary to obtain this access like modems and a computer.

3.2 You agree to pay all fees associated with the delivery of this service. Africanisp uses a debit order system and your hosting fee will

be transferred from your account every month between the 25th and 1st of the following month.

3.3. You agree to pay any loses and bank charges should your payments be returned by your banking institution for any reason whatsoever.

The fees as applicable and laid out by the bankers of Africanisp and related representatives and service providers to

Africanisp.

3.3. Africanisp also offers services on annual and quarterly payment basis. Such service may not be cancelled before expiry of such

term. Africanisp will not refund any money paid or refund any part thereof.

4. Fees

4.1 You agree to pay Africanisp the applicable fees as set out on its website http://www.africanisp.co.za and

Africanisp reserves the right to alter its fees but will provide you with adequate prior notification.

4.2 You must pay the Set-up fee and charges before service can be delivered to you.

The Set-up fee includes domain registration and setup of requested services.

4.3 Africanisp reserves the right to suspend services rendered to the "customer" should the customer fail to pay for services.

Suspended services requires activation fee which may vary from time to time.

5. Warranties

5.1 Africanisp warranties you that it will utilize the expertise and experience of its team to provide you with an excellent hosting environment.

However, this is subject to downtime caused by third parties or due to routine maintenance.

5.2 Africanisp shall only provide you with services which are specified within the Agreement.

5.3 You warrant that you are over 18 years of age and if you are not, you have obtained permission from your parent or guardian to do so.

6. Limitation of Liability

6.1 You acknowledge and agree that Africanisp will have no liability whatsoever under this Agreement, including without limitation to you for:
a) any losses whatsoever caused by downtime to service; or
b) any damage of any type suffered as a result of the loss of confidentiality of information stored on the Internet.

7. Indemnity

7.1 You agree to fully indemnify Africanisp from any claims, liabilities and expenses arising out of this agreement.

7.2 You agree to indemnify Africanisp from any Domain disputes.

8. Termination

8.1 You must provide a month's notice of your intention to terminate the service. Such notice must be written and submitted by either

mail, fax or registered mail.

9. Maintenance and Support

9.1 You can obtain technical assistance for issues concerned with your utilization of Africanisp services.

However, the service provider reserves the right to impose limitations on the extent of such support and the hours at which it is available.

10. Refund Policy
We will refund hosting payments within thirty (30) days of account activation, with the exception of setup fees, domain registration fees

and additional charges. No refunds will be issued after thirty (30) days, whether in full or prorata.

All refunds will be made by company check within thirty (30) days of receipt of cancellation.

Accounts terminated for violation of the Terms of Service do not qualify for the 30-day money back guarantee.

The refund policy only applies to new clients that tried our hosting services for one month and are not

satisfied with the results. After one month 30 days notice is required to terminate an account.

11. Domain Transfer Policy

11.1 Africanisp will not accept domain transfer request should the "customer" have fees outstanding for hosting, web design, registrar

fees or any fees due to Africanisp, it's representatives and Services providers as agreed to.
